1. About Us
The Service is operated by Chillblast Ltd (“Chillblast”, “we”, “us”, “our”), a company registered in England and Wales. Our registered address and company details are available at www.chillblast.com. References to “Chillblast” in these Terms include any trading name through which the Service may be offered.
2. Eligibility
2.1 Age and Capacity
- You must be at least 18 years of age to use the Service.
- You must be legally capable of entering into a binding contract under the laws of England and Wales.
- If you are acting on behalf of a business, you warrant that you have the authority to bind that business to these Terms.
2.2 Device Ownership
- You must be the legal owner of the device you wish to trade in, or be authorised to sell it on the owner’s behalf.
- By submitting a trade-in request, you confirm the device is free of any outstanding finance agreements, liens, or third-party ownership claims.
- Chillblast reserves the right to conduct checks against lost and stolen device databases (including the NCSC Police National Computer where applicable). If a device is found to be reported stolen or subject to a finance agreement, we will not proceed with the trade-in and may be required to retain the device and notify the relevant authorities.
2.3 Eligible Devices
- The Service is available for desktop PCs, subject to Chillblast’s published eligible device list.
- Devices must be capable of powering on at the time of submission.
- Devices that have been reported as lost or stolen are not eligible.
- Chillblast reserves the right to update the list of eligible devices at any time without prior notice.
3. Trade-In Valuation
3.1 Online Quote
You may obtain an indicative trade-in value (“Quote”) via the Chillblast trade-in tool on our website or our customer service agents. The Quote is generated based on the information you provide, including the specification, and self-assessed condition. Quotes are indicative only and not a binding offer.
3.2 Quote Validity
- Quotes are valid for 14 days from the date of issue, subject to these Terms.
- We reserve the right to withdraw or amend a Quote at any time before physical receipt and inspection of the device.
- Quotes may be affected by changes in secondary market values during the Quote validity period.
3.3 Condition Grades
When submitting a Quote request, you must select the condition grade that most accurately reflects your device:
- Excellent - Minimal signs of use. No visible scratches, dents, or marks. Fully functional with no faults.
- Good - Light cosmetic wear (minor scratches/scuffs). Fully functional with no hardware faults.
- Fair - Moderate cosmetic wear. May have noticeable scratches, marks, or surface damage. Fully functional.
- Poor - Heavy cosmetic wear or minor hardware issues. Functional but with faults as disclosed at submission.
- Faulty - Significant hardware faults or non-functional components as disclosed. Device powers on.
3.4 Revised Valuation
Upon physical receipt, Chillblast will inspect the device and may revise the Quote if:
- The actual condition does not match the grade selected at submission;
- Undisclosed faults, damage, or missing components are identified;
- Components have been substituted, modified, or removed relative to the original specification;
- The device fails to power on or pass basic operational tests.
In the event of a revised valuation, we will notify you by email and provide you the option to accept the revised value or request return of the device. If you do not respond within 5 working days, we will treat your silence as acceptance of the revised valuation, unless you have opted for device return in advance.
4. How to Trade In
4.1 Submission Process
- Obtain a Quote via our specialist customer service team and provide the required device information.
- Accept the Quote and receive your Trade-In Reference Number.
- A collection or prepaid shipping label will be arranged for the device by our customer service team.
- The device must be packaged securely and ready for collection on the agreed collection date.
- Chillblast will inspect the device within 3 working days of receipt.
- If the Quote is confirmed, payment or account credit will be issued within 3 working days of inspection completion.
4.2 Shipping
- Where Chillblast provides a prepaid shipping label, you must use the specified courier and packaging instructions. Chillblast is not responsible for loss or damage to devices in transit if the prepaid label is not used.
- You are responsible for adequate packaging to prevent damage in transit. Photos of the device packaged prior to shipping are recommended. Chillblast recommends using the original manufacturer’s packaging where available.
- If we provide a collection service, a specific collection date will be agreed separately.
5. Payment and Credit
5.1 Payment Options
Trade-in value may be redeemed as:
- Account credit for use against a new Chillblast purchase (“Store Credit”); or
- Bank transfer to a UK bank account in your name (“Cash Payment”).
The available payment options will be confirmed during the submission process. Additional conditions may apply to promotional trade-in offers.
5.2 Payment Timing
- Store Credit will typically be applied to your Chillblast account within 3 working days of inspection completion.
- Cash Payments will be made to your nominated UK bank account within 5 working days of inspection completion.
- Payment is conditional on the device passing inspection and Chillblast confirming the final agreed value.
5.3 Deductions
Chillblast reserves the right to deduct from the agreed value any reasonable costs incurred if:
- A device was described in a materially better condition than received and you have accepted a revised lower valuation;
- Collection costs were incurred and the device is subsequently found ineligible for trade-in.
6. Title and Risk
- Title in the device transfers to Chillblast upon Chillblast’s physical receipt and acceptance of the device following inspection.
- Risk of loss or damage to the device during transit to Chillblast remains with you until physical receipt by Chillblast.
- Once you accept a final valuation (including any revised valuation), you disclaim all further right, title, and interest in the device.
- If you do not accept a revised valuation and request return of the device, title remains with you throughout and Chillblast will arrange return at your cost (or at our cost where the revised valuation reduction was due to our error).
7. Data Protection and Device Security
7.1 Your Responsibility
It is your sole responsibility to remove all personal data from the device before sending it to Chillblast. This includes, but is not limited to:
- Signing out of all accounts (including cloud storage, email, and social media);
- Removing Microsoft account, Apple ID, or other platform activation locks;
- Performing a full factory reset or secure data wipe;
- Removing any encryption keys or BitLocker/FileVault credentials;
- Removing all peripheral devices, SIM cards, and external storage.
Chillblast strongly recommends using manufacturer-approved methods or certified data erasure software prior to dispatch.
7.2 Chillblast’s Data Handling
- Chillblast will perform a certified data wipe on all received devices in accordance with industry standards (including NIST 800-88 or equivalent) as part of our refurbishment process.
- In the unlikely event that a device arrives containing apparent personal data, Chillblast will not access or use that data and will securely erase it.
- Chillblast processes personal data you provide during the trade-in process in accordance with our Privacy Policy, available at www.chillblast.com/privacy-policy.
- Chillblast is registered as a Data Controller with the Information Commissioner’s Office (ICO).
7.3 GDPR
Personal information relating to you that is collected during the trade-in process is handled in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. For details of your rights and how to exercise them, please refer to our Privacy Policy.
8. Condition of Device at Submission
- You warrant that all information provided about the device (including condition, specification, and any faults) is accurate and complete to the best of your knowledge.
- You warrant that any accessories included with the device are your property and that no third-party intellectual property rights are infringed.
- Submission of a device that you know to be inaccurately described may constitute a breach of these Terms and could, in serious cases, constitute fraud.
- Chillblast reserves the right to reject any device at its discretion, including where the device poses a safety risk (e.g., swollen battery, physical damage to power components).
9. Device Return
- If a revised valuation is not accepted, Chillblast will return the device to you within 5 working days of your notification of non-acceptance.
- Return shipping costs will be borne by you unless the revised valuation was due solely to an error on Chillblast’s part.
- Chillblast accepts no liability for devices not collected or return delivery refused by the customer.
- If no response is received within 5 working days of a revised valuation notification, and no return instruction is given, Chillblast may treat the device as abandoned and dispose of it in accordance with applicable law. We will make reasonable attempts to contact you before doing so.
10. Promotions and Incentives
From time to time, Chillblast may offer enhanced trade-in values in connection with the purchase of a new system or other promotional activity. Such promotions are subject to additional terms which will be published alongside the promotion. In the event of conflict between these Terms and any promotional terms, the promotional terms will take precedence in respect of the specific promotion.
11. Part-Exchange Treatment and VAT
11.1 Single Transaction
Where you elect to apply a trade-in allowance against the contemporaneous purchase of a new Chillblast product, the trade-in and the new purchase shall together constitute a single transaction (a “Part-Exchange Transaction”). The trade-in allowance shall be applied as a reduction to the purchase price of the new product and shall not constitute a separate or independent payment by Chillblast for the traded-in device. You shall pay the balance of the purchase price, being the list price of the new product less the trade-in allowance, in cash or by such other payment method as Chillblast may accept.
11.2 VAT Treatment
In a Part-Exchange Transaction, Value Added Tax (VAT) shall be calculated and charged on the net monetary consideration received by Chillblast, being the balance payable by you after deduction of the trade-in allowance, in accordance with section 19 of the Value Added Tax Act 1994 and HMRC VAT Notice 700 (section 7.3).
12. Liability
12.1 Limitation
To the fullest extent permitted by law:
- Chillblast’s total liability to you in connection with the Service shall not exceed the trade-in value agreed for the device in question.
- Chillblast shall not be liable for any indirect, consequential, or special losses, including loss of data, loss of profit, or loss of anticipated savings.
12.2 Exceptions
Nothing in these Terms limits or excludes Chillblast’s liability for:
- Death or personal injury caused by our negligence;
- Fraud or fraudulent misrepresentation;
- Any other liability that cannot be excluded or limited under applicable law.
12.3 Consumer Rights
If you are a consumer (an individual acting outside of a trade, business, craft, or profession), nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015 or other applicable consumer protection legislation.
13. Cancellation
- You may withdraw a trade-in submission at any time before the device has been dispatched to Chillblast. Please contact us at [email protected] to cancel.
- Once the device has been dispatched or collected, you may cancel your trade-in and request return of the device before Chillblast has completed inspection. You will be responsible for return shipping costs in this case.
- Once Chillblast has completed inspection and you have accepted the final valuation, the contract is complete and the device belongs to Chillblast.
These cancellation rights are separate from and in addition to any revised valuation rights set out in clause 3.4.
14. Environmental and WEEE Compliance
Chillblast is committed to responsible recycling in accordance with the Waste Electrical and Electronic Equipment (WEEE) Regulations 2013 (as amended). Devices accepted through the Service that cannot be refurbished or resold will be disposed of through our authorised WEEE recycling partners. Chillblast holds relevant authorisations for this purpose.
15. Changes to These Terms
Chillblast may update these Terms from time to time to reflect changes in law, our services, or business practices. The Terms in force at the time you submit your trade-in request will apply to that transaction. We will publish the date of the most recent update at the top of this document.
16. Governing Law and Disputes
- These Terms are governed by the laws of England and Wales.
- Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
- If you are a consumer and wish to raise a dispute, you may also contact the Citizens Advice consumer helpline or use an Alternative Dispute Resolution (ADR) scheme. Details of available ADR schemes can be found at www.gov.uk.
