Overview
Chillblast is a British retailer of high end computer parts for the discerning enthusiast. We specialise in providing the very best products, both mainstream and niche, at prices that offer great value. Customer service is the mainstay of our company, and we always endeavour to meet your deadlines and provide excellent after-sales service.

Security
There is a great deal of misinformation concerning the security of buying products via a website. Studies have shown that there is no increased risk in purchasing online than in any other form of mail order. When you place an order with us all the details are sent to a remote secure server via an encrypted connection (128bit SSL) where they are also stored in an encrypted manner. When we collect and process your order the details are again transferred via an encrypted connection. You as a consumer are protected against all forms of fraud by the Consumer Credit Act of 1974.

Privacy
Any personal information provided or to be gathered by Chillblast.com is controlled primarily by Clear Core Ltd, Unit 10 East Avenue, Talbot Woods, Bournemouth, Dorset BH3 7BY. We are committed to protecting your privacy. We will only use the information that we collect about you lawfully (in accordance with the Data Protection Act 1998). We collect information about you for 2 reasons: firstly, to process your order and second, to provide you with the best possible service. We will give you the chance to refuse any marketing email from us. We will not sell, trade or rent your personal information to others.

The type of information we will collect about you includes:

your name
address
phone number
email address
credit/debit card details

We will never collect sensitive information about you without your explicit consent. The information we hold will be accurate and up to date. You can check the information that we hold about you by emailing us. If you find any inaccuracies we will delete or correct it promptly. The personal information which we hold will be held securely in accordance with our internal security policy.

If we intend to transfer your information outside the EEA (European Economic Area) we will always obtain your consent first. We do not use third party ad servers, and only place two cookies on your computer to enable you to navigate and use our site more easily. These cookies are set to expire after a 12 month period of not visiting our site. By using our Web site, you consent to the collection and use of this information by Chillblast.com. If we decide to change our privacy policy, we will post those changes on this page so that you are always aware of what information we collect, how we use it and under what circumstances we disclose it.

Your Statutory Rights
By law, you also have the right to withdraw from your purchase of an item within seven working days of the item's delivery to you. We regret that we cannot accept cancellations of contracts for the purchase of products where the item has been unsealed. All unused returned items are subject to a full refund less the shipping charge and a 5% credit card surcharge. To exercise your right of cancellation, you must give us written notice by hand, post, fax or email, giving details of the goods ordered and (where appropriate) their delivery, please head this notice "contract cancellation". Notification by phone is not sufficient. Please note this policy does have some limitations and does not apply to business customers.

Please note that you will be responsible for the cost and safety of returning the goods to us unless we delivered the item to you in error or if the item is faulty. he goods must be returned to the address shown on the invoice. You must take reasonable care to ensure the goods are not damaged in the meantime or in transit. For your protection, we recommend that you use an insured recorded-delivery service.

As soon as we receive notice of your cancellation of the order and its safe return, we will refund the relevant part of the purchase price for that item together with the item's normal postage charge within 30 days --we cannot refund any priority, express or courier component of the postage charge. Terms and Conditions of Sale
The following terms and conditions apply to all transactions on www.chillblast.com. The placing of an order indicates your acceptance of these terms and conditions. Please read them carefully and print a copy for future reference. These terms and conditions do not affect your statutory rights. To order goods through this website you must be at least 18 years of age. We will treat each order for goods as an offer by you to purchase the goods subject to these terms and conditions.

IT IS ONLY WHEN WE HAVE DISPATCHED THE GOODS TO YOU THAT WE HAVE A BINDING CONTRACT.

We have the right to refuse at our discretion to supply any goods ordered by you.

Description of Goods/ Warranty and Liability
Although we warrant that the Goods will at the time of delivery correspond to the description given by us all products we sell are of a technical nature and it is not practical to publish detailed specifications of all the products. All images, descriptive matter, specifications and advertising are for the sole purpose of giving an approximate description of the goods. Full details are available from the original manufacturers brochures & websites. Except where the Customer is dealing as a consumer (as defined in the Unfair Contract Terms Act 1977, section 12) all other warranties, conditions or terms relating to fitness for purpose, merchantability or conditions of the goods whether implied by Statute, Common Law or otherwise are excluded and the Customer warrants that the Customer is satisfied as to the Suitability of the Goods for the Customer's purpose. Goods are not sold on a trial basis.

If you buy goods which have no published technical specifications, it is your responsibility to establish the suitability of the goods for your intended purpose.

Typographical Errors
In the event that a product is listed at an incorrect price due to a typographical error or error in pricing information from our suppliers, we shall have the right to refuse or cancel any orders based on the incorrect price whether or not the order has been confirmed.

Payment Method
On the order you must provide us with your exact address and telephone number that your credit card issuer has on file for you. Your order can only be shipped to an address registered with your card issuer. This is for your security as a cardholder as much as for ours. If the information held by your issuer is incorrect or out-of-date it is your responsibility to update this information. We accept no liability for delays or order cancellation due to this .

Availability of Goods
All products are subject to availability and may be withdrawn at any time. However it is our policy to contact you if a product is out of stock and if you do not wish to proceed with the order or for any reason we cannot supply the product we will arrange for the order to be cancelled.

We offer an extended range of products which are obtained directly from our distributors and manufacturers. These products are subject to stock availability and delivery dates made by these parties' own delivery services. It is our policy to contact you to explain the stock and delivery situation with these products. Again if you do not wish to proceed with the order, we will arrange for it to be cancelled.

Delivery
Whilst every reasonable effort shall be made to keep any delivery date, time of delivery shall not be of the essence and we shall not be liable for any losses, costs, damages or expenses incurred by the Customer or any other person or company arising directly or indirectly out of any failure to meet any estimated delivery date.

Unless otherwise agreed we may deliver by instalments and any delay, default or non-delivery in respect of any instalment shall not entitle the Customer to cancel the remainder of the Contract.

Failure by the Customer to pay for any instalment or delivery when due shall entitle us to withhold further deliveries and the Customer shall be liable for any costs incurred by the Supplier relating to such Goods which the Supplier is then entitled to withhold.

Delivery of the Goods shall be made to the Customer's address and the Customer shall make all arrangements necessary to take delivery of the Goods whenever they are tendered for delivery.

Where an incorrect address has been given to Chillblast.com with an order we reserve the right to charge for any extra carriage costs incurred.

Note: If you ordered several items to be delivered to the same address, we may send them to you in separate packages to give you the fastest service. This will not affect your delivery charges.

Time Limitations for Notification of claims.

Damaged in Transit
Should there be any damage to the delivered goods, details must be noted on the delivery documentation and it will be your responsibility to inform us immediately, but not later than within 7 working days. It is imperative that you do not dispose of any of the packaging, as this will be required to affect your claim against the carrier. We will make a claim against the carrier and arrange for the damaged goods to be collected and replacements to be sent to you.

Shortages
It is your responsibility to sign for the correct number of packages as shown on the delivery or carriers consignment note. If you suspect that there are items missing from the delivery, first check that the order has not been part shipped. Any shortages must be noted on the delivery notes and it is your responsibility to notify us within 2 days of delivery.

Incorrect Goods
It is your responsibility to notify us of any incorrect goods supplied within 2 days of delivery. If the items are not what you ordered, you must not open the manufacturers packaging or use the item.

Non-Deliveries
We will not accept liability for goods lost in transit unless we are notified within 10 days from the expected delivery date. We shall accept no liability for shortages, non-deliveries, incorrect goods and goods damaged on delivery outside the reported timescales. Except when extenuating circumstances have prevented notification within the reported timescale.

Product Guarantees
All products supplied are covered by the terms and conditions of the Original Manufacturers Guarantee for a period of 12 months or longer if relevant.

Cancellation of Orders
Orders cancelled after despatch of the goods will be subject to a minimum handling fee of 15% of the invoice price to cover re-stocking and administration costs.

Items no longer required
If you are not totally satisfied with your purchase, you can return it within 7 days from date of invoice for a refund (excluding delivery charges) provided it is in pristine condition in its original box and packaging. You will be wholly responsible for the cost of delivery and safe return of the goods. Goods received back incomplete or in a damaged or used condition will be returned to you and the cost of re-delivery charged to your account. If the product has been unsealed we reserve the right to charge a restocking fee of up to 15% of the value of the product.

We cannot accept the return of opened software packages or consumable items (e.g. ink cartridges, paper), you will need to contact the manufacturer directly in these instances.

You must use the "return an item" link under "contacts" or "my account" to obtain a Returns Authorisation (RMA) number and to arrange return delivery of the item(s). The RMA number must be quoted on the returned items. Any items returned without an RMA number will be rejected. Please be aware that we will not refund the carriage paid on the original order, or the cost of returning the items to us. Goods must be returned in the manufacturers original packaging together with any additional enclosures, such as Manuals, free software etc. You must ensure that adequate packaging is used to return the goods. We reserve the right to reject any item(s) returned that do not meet the criteria laid out above.

You do not have the right to cancel the contract if the order is for a custom built PC (i.e. built to customers specification), these are built to the specifically for the customer and as described in section 13 of the Distance Selling Regulations 2000 cannot be returned under the 7 working day "cooling off period". Please see 13 of the Distance Selling Regulations 2000 for further information.

Faulty Goods
If you think that the product you have purchased is faulty or incompatible with your computer system we may refer you to the manufacturer, due to their extensive knowledge of their product. If the manufacturer agrees that the product is faulty, in most cases they will be able to authorize a replacement/repair of the product direct to you.

A restocking fee of up to 25% is charged on returns, which prove to be non-defective.

Opened software shall not be accepted for credit. If any discs are found to be faulty you may be asked to contact the manufacturer directly.

Dead on Arrival (DOA)
If the product fails within the manufacturer's DOA period, a replacement product will be offered to you.

Water Cooling
Water Cooling is a very effective and high performance way to cool your PC, but there is an inherent risk involved with all water cooling products. Should you wish to use water cooling in your PC, Chillblast will not be held responsible for any damage done in the event of mis-installation or product failure. We recommend that all water cooling products be tested for no less than 24 hours outside your PC case to check for leaks before it is installed into the final system.

Systems
Once you place an order for a system, there is a non-refundable 10% deposit. There is a 15% non-refundable deposit for systems with a custom specification. All Chillblast desktops are built to the highest standards using the finest components available, but we cannot guarantee compatibility with all software you wish to use, or all features of a given operating system due to the near infinite variety of customisable options available. Please note that in the case of our off-the-shelf systems we reserve the right to upgrade components to superior parts. We will never change stock components for an inferior product. As with most desktop PC systems, the use of sleep mode is not recommended as there is a chance your PC will not resume correctly. This and other hibernation features are used entirely at your own risk.

You do not have the right to cancel the contract if the order is for a custom built PC (i.e. built to customers specification), these are built to the specifically for the customer and as described in section 13 of the Distance Selling Regulations 2000 cannot be returned under the 7 working day "cooling off period". Please see 13 of the Distance Selling Regulations 2000 for further information.

Refunds
If for any reason you are issued with a refund, please note the following:

All refunds will be issued to the same payment method as on the original order. A refund will usually reach your credit card account within 4 working days, please allow up to 10 working days for it to be credited. Goods returned within the manufacturer's DOA period, will be refunded in full. If the goods are found not to be faulty or they have been damaged by miss-use, they will be returned to you and no refund will be issued. The relevant manufacturer will process all offers of "Money Back" guarantees and you should contact them directly to arrange return and refund.

Liability
Except as may be implied by law and except in the case of death or personal injury where the Customer is dealing as a consumer, in the event of any breach of these Terms and Conditions by us the remedies to you shall be limited to damages which shall in no circumstances exceed the price of the Goods and we shall under no circumstances be liable for any indirect, incidental or consequential damages.

Force Majeure
We will not be under any liability whatsoever in the event that we are prevented or delayed from supplying or making delivery of any Goods by any reason or cause beyond our control.

No Waiver
Our failure to insist upon strict performance of any provision of these Terms and Conditions shall not be deemed to be a waiver of our rights or remedies in respect of any present or future default of the Customer in performance or compliance with any of these Terms and Conditions.

Severability
In the event that any or any part of these Terms and Conditions shall be determined invalid, unlawful or unenforceable to any extent such term, condition or provision shall be severed from the remaining Terms and Conditions, which shall continue to be valid and enforceable to the fullest extent permitted by law.

These Terms and Condition shall be construed in accordance with English Law.

Warranty
Unless otherwise stated warranty extends for a period of one year from the purchase date. Warranty excludes any faults resulting from user abuse. We accept no liability of any kind for lost data or any consequential losses or loss of earnings or profits due to repairs. This includes failed BIOS updates unless you have been instructed to carry out such a procedure by our engineers. If there is no fault found with the system or if the fault is the direct result of user error or if our engineers are denied access to equipment for any reason, a charge will be made. We reserve the right to remove the PC from site for in-house repairs. No refunds or compensations are possible due to the failure of the system. Warranty applies to original owner of the system and is non-transferable. Warranty is void if any attempt is made to repair the system by non-authorised persons or if charges are not paid. Under a RTB (Return To Base) warranty, the customer is responsible for the cost and safe return of the equipment. Inadequately packaged items may be rejected. In all cases, the original packaging of the goods must be retained. Systems purchased from Chillblast.com will be refused and returned to sender if they are sent in anything other than the original box. If you have already thrown away your packaging, you must contact us for detailed packaging instructions before sending it back to us and any damage to the system, whether picked up by Chillblast or sent back using your own courier is entirely your own responsibility. 

From time to time we may offer advance replacements of hardware which we can diagnose as faulty by phone or email. If you take advantage of this offer, we do expect the faulty hardware to be returned to us within 10 working days of you receiving the replacement unless any special arrangement has already been made. If we do not receive the faulty hardware within a reasonable period of time, we will first contact you with a reminder, and beyond this we will issue an invoice for the hardware which must be paid in full.

International orders.

Address verification
It is very difficult to obtain verification information from banks outside of the UK. For your protection, in most cases you will be required to fax or e-mail us a copy of your most recent credit card statement together with copies of the front and back of your card. If you are ordering from outside the UK, please contact your credit card issuing bank and ask them to release address verification information to Chillblast.com. Without this verification, we will be unable to process your order.

Chillblast.com cannot issue credit for International packages which are refused or abandoned.

The products we sell are designed to work with UK specifications only. You should check to see if the products we sell will work with your local area's electronics specification.

You will be the importer of record and will be responsible for all levies, duties, import fees, taxes, and other charges. Chillblast.com strongly suggests that you check with your local government agency to determine the extent of such charges prior to purchase. Chillblast.com cannot issue credit in cases where packages are not delivered due to non-payment of fees.

Chillblast.com cannot ship to PO Boxes, and we cannot ship to mail forwarding services. Please be informed that your designated shipping to address must reflect the address of the ultimate end-user. Chillblast.com will not process any order which specifies an address of a freight forwarder, warehouse, distribution centre, airport or hotel.

International system orders.
If you order a computer system as an international customer the collect and return warranty offered does not apply. Support for the same period of time will be provided, but on a 'return to base' basis. In the event of system failure you are therefore responsible for arranging carriage of the system back to ourselves, and we will cover all charges required to return the system to you after its repair.

All prices exclude VAT unless stated otherwise. In order to get next working day delivery orders must be placed before 3:30pm. All Web orders are subject to availability and to the Terms and Conditions of Clear Core Ltd.

Delivery and risk
The equipment is at your risk from the time of delivery. Delivery takes place either at our premises (if you are collecting it or arranging carriage) or from the time of delivery to the customer (if we are arranging carriage). You must inspect the equipment on delivery. If any equipment is damaged during delivery you must immediately file a claim with the carrier and send a copy of that claim together with a full report of the damage to us within three days. Our receipt of such a claim does not constitute our acceptance of any liability. You must inform us in writing within three days of the expected delivery date if any equipment is not delivered on the expected delivery date.

Payment terms
You are to pay us in cleared funds, unless you have an approved credit account. If you have an approved business credit account, payment is due no later than 7 days after the date of our invoice unless otherwise agreed in witting. Our invoices are dated with the date of delivery.  If you fail to pay us in full on the due date:

  • we may suspend or cancel future deliveries,
  • we may cancel any discount offered to you,
  • you must pay us interest at a rate equivalent to that set for the purposes of s6 of the Late Payment of Commercial Debts (Interest) Act 1998:

A) calculated (on a daily basis) from the date of our invoice until payment;
B) compounded on the first day of each calendar month; and
C) before and after any judgment (unless the court orders otherwise).

If you have an approved credit account, we may withdraw it or reduce your credit limit or bring forward your due date for payment. We may do any of those at any time without notice. You do not have the right to set off any money you may claim from us against anything you may owe us. While you owe money to us, we have a lien on any of your property in our possession. You are to indemnify us in full and hold us harmless from all expenses and liabilities we may incur (directly or indirectly and including legal costs on an indemnity basis) following any breach by you of any of your obligations under these terms

All Sums” Retention of Title
Until you pay all debts:

  • All equipment supplied by us remains our property
  • You must store it so that it is clearly identifiable as our property;
  • You must insure it (against the risks for which a prudent owner would insure it) and hold the policy on trust for us;
  • Title to the goods will not pass until all sums due under any contracts have been paid. You are obligated to keep all sale proceeds of the goods in a separate fiduciary account until payment for the said goods has been made in full
  • Despite our all sums retention of title clause, we have the right to take legal proceedings to recover the price of equipment supplied should you not pay us by the due date.
  • You are not our agent You have no authority to make any contract on our behalf or in our name

Unless:
A) We revoke that right (by informing you in writing), or
B) you become insolvent

You must inform us (in writing) immediately if you become insolvent. If your right to use and sell the equipment ends you must allow us to remove the equipment. We have your permission to enter any premises where the equipment may be stored at anytime, to inspect it and after your right to use and sell it has ended, to remove it, using reasonable force if necessary.

Security
For your protection we use secure sockets to protect your payment details. This happens automatically when you are ready to place your order and means that the details you supply and responses from us are encrypted before they are sent over the Internet.

Certification
Chillblast.com has a certificate for secure sockets issued by Thawte, for your protection.

Complaints
We endeavour to reply to any complaints within a 5 day period. Please send any complaints in writing to Chillblast.com marked "Complaints Department" and mailed to our registered address:
